Terms of Sale

These terms (“Terms”) govern the offer for sale by Mighty Jaxx International Pte. Ltd (“Mighty Jaxx”), and the purchase and acceptance by you, of our products under the “Superkraft” brand (the “Product”).

By purchasing the Product, you agree to be bound by these Terms, including any additional relevant terms, conditions, rules, guidelines, and policies referenced herein, on our website and/or made available by hyperlink.

Please read these Terms carefully before completing your purchase.

  1. PURCHASE TERMS

    1. By placing an order for the Product, you acknowledge that your purchase is made on a pre-order basis. This means that the Product is made-to-order and has not been manufactured yet. While we strive to have the Product delivered to you in a timely fashion, given the hand-made and custom nature of the Product, it may take several months to reach you. Any shipping dates provided are estimates only, and time of delivery for the Product shall not be of the essence.
    2. Mighty Jaxx endeavours to ensure that descriptions, images and details provided for the Product are accurate, but the final Product may contain minor differences in colour or design due to the production process.
    3. All designs are subject to licensor approval, and may be subject to additional changes or updates. Any changes will be communicated to you where possible, but Mighty Jaxx will not be liable for any failure or delay in communicating such updates or changes.
    4. All applicable taxes, duties, and custom fees are the sole responsibility of the customer. These charges are not included in the Product price, and customers are advised to check with their local customs office regarding these additional costs.

  2. PAYMENT OPTIONS

    1. You have a choice of completing payment for your purchase of the Product through three methods:
      1. Full payment for the Product at checkout; or
      2. Placing a thirty-percent (30%) deposit for the Product at checkout to secure your order, with the remaining balance to be paid when we notify you that the Product is ready to ship. Note that if you do not make payment on the remaining balance within seven (7) days of the date of our notification, Mighty Jaxx reserves the right to cancel your order without refund of your deposit. In such case, your Product may be released for sale to other customers.
      3. Payment via a buy-now, pay later scheme (“BNPL”). Our BNPL scheme is provided by Klarna, a third-party service provider. As Klarna is an independent service provider, if you select this option at checkout:
        1. you agree to comply with Klarna’s applicable terms and conditions, including Klarna’s rights to approve or deny your BNPL request at its discretion;
        2. your order is only confirmed once Klarna has approved your payment plan and the transaction is successfully processed between us and Klarna; and
        3. Mighty Jaxx shall not be responsible or liable for any of Klarna’s terms, schedules or enforcement of payments.
    2. If you are selected as the winner for any raffles, giveaways or other promotional competitions administered by Mighty Jaxx in relation to the Product (a “Raffle”, see Raffle Terms below), you will be required to make full payment of any balance on the Product upon acceptance of the item, and within the time notified by us to you.
    3. Mighty Jaxx reserves the right to designate a subsidiary or affiliate entity (“Nominee”) to receive any payment due on any purchase of the Product on its behalf. In such instance, collection of payments may be carried out through the use of the Nominee’s account on third-party service platforms such as “Stripe” or “Paypal”. The Nominee shall be appointed solely for the purpose of collecting payment, and shall not otherwise affect Mighty Jaxx’s obligations for fulfilment and delivery of the Product to you.

  3. RAFFLE TERMS

      Eligibility

    1. Where eligible, by purchasing the Product from our website, with or without any customisation, you will automatically be entered into the raffle to stand a chance to win a limited edition of the Product (the “Raffle Edition”), save for purchases made through the following, which shall not be eligible for the Raffle:
      1. Purchases made from our website where we have communicated that the Raffle for the relevant Product is closed; or
      2. Purchases made from our website, but accessed via any links provided by our partners, affiliates, or third-party platforms.
    2. Subject to Clause 3.1 above, each purchase of a Product entitles you to one automatic Raffle entry, and each Raffle entry grants you one chance to win the relevant Raffle Edition. You are entitled to an unlimited number of Raffle entries.
    3. Raffle entries are only valid for Product purchases made through our website.
    4. Customers whose purchases are cancelled for any reason will automatically be disqualified from the Raffle for the corresponding Product. In addition, any prohibited conduct such as fraudulent entries, failure to meet eligibility requirements, or providing false information, may also result in disqualification from the Raffle at Mighty Jaxx’s sole and absolute discretion.
    5. Additional terms and conditions (“Additional Terms”) regarding a Raffle may be specified on the relevant Product page, promotional materials, or on our website. In the event of any conflict or inconsistency between such Additional Terms and these Terms of Sale, the Additional Terms shall prevail.

      6. Selection and Notification of Winners

    6. The Raffle draw will take place on a date to be communicated, where a winner will be selected through a random draw process. The winner will then be notified via the email address provided during their purchase.
    7. The winner will have the option to:
      1. Accept the upgrade to the Raffle Edition, in accordance with Clause 3.8 below. Upon acceptance of the Raffle Edition, the winner’s original order (including any customisations) will be automatically be upgraded to the Raffle Edition, and their original order will be forfeited. The Raffle winner will only be required to pay in aggregate the purchase price of their original order – no additional fees are required for the upgrade to the Raffle Edition; or
      2. Elect not to accept the upgrade to the Raffle Edition, in which case the winner’s original order will be retained, and the Raffle Edition will be awarded to the next selected winner.
    8. A selected winner may accept the upgrade to the Raffle Edition by providing their confirmation within the time period specified in our email notification. Where the selected winner made payment on his/her original order via a deposit per Clause 2.1.2, the balance of their original order will also become due in accordance with the time period specified in our notification email. If the selected winner fails to provide their confirmation or pay any required balances within the specified time period, the selected winner will be deemed to have declined to accept the Raffle Edition upgrade, and his/her original order will be retained, and the Raffle Edition will be awarded to the next selected winner.

      9. Disclaimers, Indemnities and Limitation of Liability

    9. Mighty Jaxx reserves the right, in its sole and absolute discretion, to select an alternative winner at any time, for any reason whatsoever, including but not limited to instances where the initially selected winner is found to be ineligible, fails to comply with the Raffle rules or these terms and conditions, or where Mighty Jaxx determines, in its sole and absolute discretion, that an alternative selection is warranted. Mighty Jaxx’s decision in this regard shall be final and binding, and has no obligation to entertain any further correspondence or discussion on this matter.
    10. This Raffle is open to global customers. All prizes won by minor(s) will be awarded to their parents or legal guardians on their behalf.
    11. In consideration for your participation in the Raffle, you hereby release and forever discharge Mighty Jaxx, and its officers, board and employees, jointly and severally from any and all actions, cause of actions, claim and demands for, upon or by reason of any damage, loss or injury including death, which hereafter may be sustained by participating in such giveaway. This release extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, damages, loss and liability and the consequences thereof including death, as well as those now disclosed and known to exist.
    12. It is further understood and agreed that any participation in this Raffle is not to be construed as an admission of any liability and acceptance of assumption of responsibility by Mighty Jaxx, its officers, board and employees, jointly and severally, for any damages and expenses for which Mighty Jaxx, its officers, board and employees, may become liable as a result of any alleged act of the participant.
    13. Prizes are non-transferable and cannot be redeemed or exchanged for cash or credit.
    14. Mighty Jaxx reserves the right to offer an alternative prize if any prize is not available or under any other special circumstances.
    15. Occasionally, we may amend these terms and conditions without prior notice. We advise our customers to review these terms and conditions periodically to be updated of any changes.

  4. SHIPPING AND FULFILMENT

    1. The shipping and delivery of your purchase are governed by our Shipping Policy, which can be found here. By completing your purchase with us, you agree to be bound by the terms provided in our Shipping Policy.
    2. Your purchase may be shipped in multiple shipments, which may depart from their point of origin at different times, originate from different locations, or be delivered by different shipment providers. Accordingly, parts of your order may arrive on different dates, even if your purchase was carried out in a single transaction.
    3. Shipment timelines and carrier availability may vary depending on your shipping address, customs processing, and third-party carrier performance. Mighty Jaxx does not guarantee delivery by a specific date, and shall not be liable for any delays caused by customs, couriers, weathers, or other external circumstances beyond our control.
    4. Shipping fees paid at checkout are non-refundable once a shipment is processed, unless otherwise required under applicable law. Any return or redelivery costs incurred as a result of incorrect or incomplete shipping addresses provided by the customer shall be borne by the customer.
    5. Risk of loss and title for the Product passes to you upon our handover of the Product to the shipment provider.
